This Damage and Loss Policy ("Policy") outlines the terms and conditions under which the individual renting the camping gear ("Renter") and supplies ("Equipment" or "Gear") is responsible for the rented items provided by Cool Camp Rentals, LLC ("Owner"). This Policy is an integral part of the Camping Gear Rental Agreement accessible on our website and applies to any rental transactions entered into by the Owner and Renter.
1. Responsibility for Damage or Loss:The Renter agrees to be fully responsible for any damage to, or loss of, the Equipment from the time of receipt until the Equipment is returned to the Owner, excluding normal wear and tear. Normal wear and tear refer to minor and reasonable wear or deterioration that occurs through regular use of the Equipment.
2. Damage Reporting:The Renter agrees to inspect all Equipment upon receipt and report any pre-existing damage to the Owner immediately. Failure to report pre-existing damage may result in charges for damages found upon return of the Equipment.
3. Accidental Damage:In the event of accidental damage to the Equipment, the Renter agrees to notify the Owner immediately. The Owner will assess the damage and determine whether the Equipment can be repaired or if it must be replaced.
4. Charges for Damage:The Renter agrees to permit the Owner to maintain a record of their payment method on file for up to three (3) days after the return of the Equipment for the purposes of processing charges related to late fees, and for damaged or lost items, as outlined in this Policy. If the Equipment is damaged and can be repaired, the Renter will be charged for the lesser of the repair cost or the replacement cost of the Equipment. If the Equipment is damaged beyond repair or the repair cost is deemed uneconomical, the Renter will be charged the full replacement cost. Human or Animal waste and/or bodily fluids will require a full replacement.
5. Loss or Theft:In the event of loss or theft of the Equipment, the Renter is responsible for notifying the Owner immediately. The Renter will be charged the full replacement cost of the Equipment if the Owner is unable to recoup losses by other reasonable means.
6. Payment for Damages or Loss:Any charges for damages or loss must be paid by the Renter upon notification by the Owner which may occur up to three (3) days after the return of the Equipment. Any additional charges will be communicated to the Renter before attempting to bill or charge any stored payment methods on file.
7. Limitation of Liability:The Renter shall be solely responsible for any accidents or injuries to themselves or third parties caused by or during the use of the Equipment. Camping and outdoor recreation is a risky and potentially dangerous activity by nature and by renting Equipment from the Owner the Renter fully acknowledges this fact and agrees to indemnify and hold the Owner harmless from any claims, damages, or expenses resulting from the Renter’s use of the equipment.
8. Insurance:The Renter is encouraged to secure their own insurance coverage for the Equipment during the rental period to cover any potential damage or loss. The Owner does not provide insurance coverage for the rented Equipment. Contact your existing insurance broker for details.
9. Acknowledgment:By checking the boxes on the Order Checkout Page on our app, which is required to submit an Order for Equipment, the Renter acknowledges having read, understood, and agrees to the terms of this Damage and Loss Policy.
This Policy is subject to change at the discretion of the Owner, and any changes will be communicated to the Renter in writing. The Renter's continued use of the Equipment following any changes to this Policy constitutes acceptance of those changes.
