Camping Gear Rental Agreement

This Rental Agreement ("Agreement") is provided by Cool Camp Rentals, LLC ("Owner") and will be entered into by the Owner and the individual renting the camping gear ("Renter") upon payment for the reservation of any supplies ("Equipment" or "Gear"). The specific details of the rental items will be specified at the time of rental. This policy includes all items, packages, and other services or equipment.

1. Payment Methods:

The Renter agrees to permit the Owner to maintain a record of their payment method on file for the purposes of processing charges related to late fees and for damaged or lost items as outlined in the Damage and Loss Policy for up to three (3) days after the date of Equipment return.

2. Rental Fees:

The Renter agrees to pay the full rental fee ("Base Fee") at the time of checkout and reservation for the use of the item(s) or service(s) being rented or purchased. The Base Fee is payable in full before the reservations are placed. Any additional fees not including the Base Fee will be communicated with the Renter before attempting any additional charges.

3. Rental Period:

The rental period is determined by the dates selected by the Renter based on Equipment availability including the selected Delivery Dates and Return Date, unless extended or modified with the consent of the Owner. All pricing is per day, unless specified otherwise, and the total Base Fee is based on this rental period.

4. Use of Equipment:

The Renter agrees to use the Equipment only for the intended purpose of the Equipment and in accordance with any instructions provided by the Owner. The Renter shall not sublease or assign the Equipment to any third party or use it for any commercial purposes without explicit written consent from the Owner.

5. Damage and Loss Policy:

The Renter is required to accept the Owner’s Damage and Loss Policy, which outlines the Renter's responsibilities in the event of damage or loss of the rented items. Any damage or loss may result in additional charges, as detailed in the separate Damage and Loss Policy Agreement.

6. Return of Equipment:

The Renter agrees to return the rented items to the Owner in the same condition as when received, barring normal wear and tear, on or before the end date of the rental period. Any additional rental days or late return of the Equipment will result in charges for the additional days.

7. Late Return:

In the event of a late return, the Renter shall be charged an additional fee equal to the Base Fee divided by the original requested number of days, per day plus an additional $100 fee until the equipment is returned.

8. Cancellation Policy:

The Renter may cancel this Agreement at any time prior to the start date for a full refund in store credit. We do not offer cash refunds as stated in our Refund Policy.

9. Limitation of Liability:

The Renter shall be solely responsible for any accidents or injuries to themselves or third parties caused by or during the use of the Equipment. Camping and outdoor recreation is a risky and potentially dangerous activity by nature and by renting Equipment from the Owner the Renter fully acknowledges this fact and agrees to indemnify and hold the Owner harmless from any claims, damages, or expenses resulting from the Renter’s use of the equipment.

10. Governing Law:

This Agreement shall be governed by the laws and jurisdiction of Maricopa County, Arizona.

11. Amendment:

This Agreement may only be amended in writing and signed by both parties.

12. Acceptance of Agreement:

By checking the boxes on the Order Checkout Page on our app, which is required to submit an Order for Equipment, the Renter acknowledges having read, understood, and agrees to be bound by the terms of this Agreement.
